Health and Safety doesn’t work that way. It’s up to an employer to do everything reasonable and practicable and ensure that the workplace is free from hazards.

The onus is on the employer to:

  • Identify all hazards associated with the work being conducted.
  • Develop and implement systems and controls to ensure that employees are not harmed as a result of those hazards.

Sometimes this requires an employer to ensure that employees do not come to harm through their own foolishness, ignorance or basic stupidity.

If employees are harmed because they did not comply with a reasonable instruction, employers cannot defend themselves by saying “I told him it was dangerous but he did it anyway”. In this case, the employer would be liable because the safe system of work was not enforced.
